Wholly Industry Funded Collaborative Research Programmes and Part Industry Funded Collaborative Research Programmes should be governed by appropriate Collaborative Research Agreements. These Collaborative Research Agreements should include:
- A Project Plan setting out details of the research programme and the roles of each party in relation to the research programme.
- A Project Budget setting out the contribution the industry party is making to the costs of the research programme.
- Mechanisms for the identification and protection of IP developed during the research programme (often called “Foreground IP”).
- Terms and conditions related to the protection and management of IP developed during the research programme including, where relevant, payment of associated costs.
- Terms and conditions related to the licensing and/or assignment of IP arising from the performance of the research programme.
- Terms and conditions related to the licensing of pre-existing IP introduced into the collaboration and owned or licensed by the RCSI and/or the industry party (usually called “Background IP”).
- Terms and conditions related to the publication of research programme results.
- Details of the management and oversight of the research programme.
